6.1 mdbeautyskin.com is an e-shop, hereinafter referred to as the Provider, available at the Internet address mdbeautyskin.com, through which Users are able to conclude contracts for the purchase and delivery of the goods offered by mdbeautyskin.com, including the following:
- To register and create an account to view mdbeautyskin.com and use the additional services to provide information;
- To enter into contracts for the purchase and delivery of the goods offered by mdbeautyskin.com;
- To make any payments in connection with contracts entered into with mdbeautyskin.com, in accordance with the payment methods supported by mdbeautyskin.com.
- To receive information about new products offered by mdbeautyskin.com;
- To review the goods, their characteristics, prices and delivery terms;
- To be informed of the rights arising from the law through the interface of the mdbeautyskin.com website.
6.2. The Supplier delivers the goods and guarantees the rights of the Users provided for by law, within the framework of good faith, the criteria and conditions accepted in practice, consumer or commercial law.
6.3. Users conclude a contract for the purchase and sale of the goods offered by mdbeautyskin.com through the interface of the Supplier, available on its website at mdbeautyskin.com or other means of remote communication.
6.4. The User and the Supplier agree that all statements between them in connection with the conclusion and performance of the Purchase and Sale Agreement may be made electronically and by electronic statements within the meaning of the Electronic Document and Electronic Signature Act and Article 11 of the Electronic Commerce Act.
6.5. The Supplier shall deliver and hand over the goods to the User within the period specified at the conclusion of the contract. If the time limit is not expressly agreed between the parties at the conclusion of the contract, the Supplier shall deliver and hand over the goods within a reasonable time, but not later than 2 months.
6.6. The User must inspect the goods at the time of delivery and handover by the courier company and if it does not meet the requirements to notify the Supplier immediately. If the User does not submit his claims for claim, the delivery shall be deemed accepted and approved.
6.7. When registering, the User undertakes to provide correct and up-to-date data. The User shall promptly update the details provided in his registration in the event of a change.
7. SPECIAL OBLIGATIONS OF THE SUPPLIER
7.1. The rules of this section of these General Terms and Conditions shall apply to Users who, according to the data provided for the conclusion of the purchase contract or upon registration at mdbeautyskin.com, may be inferred to be consumers within the meaning of the Consumer Protection Act, the Electronic Commerce Act and/or Directive 97/7/EC of the European Parliament and of the Council of 20 May 1997 on the protection of consumers in respect of distance contracts.

The price of the goods including all taxes is determined by the Supplier in the profile of each item on the mdbeautyskin.com website.
The value of postage and transport costs not included in the price of the goods shall be determined by the Supplier and shall be provided as information to the Users at one of the following times prior to the conclusion of the contract:
- In the profile of each of the goods on the Supplier’s website at mdbeautyskin.com;
- When selecting the goods to conclude the purchase contract;
- The method of payment, delivery and performance of the contract shall be defined in these General Terms and Conditions, as well as the information provided to the User on the Supplier’s website.
The information provided to the Users under this Article is up-to-date at the time of its visualization on the Provider’s website at mdbeautyskin.com prior to the conclusion of the Purchase Agreement.
The Supplier must indicate the terms of delivery of individual goods on the mdbeautyskin.com website;
The Supplier shall state before the conclusion of the contract the total value of the order for all the goods contained therein.
7.2. The User agrees that the Supplier shall be entitled to accept advance payment for contracts concluded with the User for the purchase and delivery of goods.
The User chooses independently whether to pay the Supplier the delivery price of the goods before or at the time of delivery.
7.3. The consumer has the right, without compensation or penalty and without giving any reason, to withdraw from the contract within 7 working days from the date of receipt of the goods. In case the payment is made with a bank card, the refund is made by ordering a reverse transaction on the card with which the payment was made within 30 days.
The right of withdrawal shall not apply in the following cases:
- for the supply of goods and services, the price of which depends on fluctuations in the financial markets which the Supplier is unable to control;
- for the delivery of goods made according to the user’s requirements or to his individual order;
- for the delivery of goods which, by their nature, cannot be returned or are perishable or are in danger of deterioration, including perfumery and cosmetic products;
- for a product with damaged integrity / unpacked by the User;
Where the Supplier has not fulfilled its obligations to provide information as set out in Article 54 of the Consumer Protection Act, the consumer shall have the right to withdraw from the concluded contract within three months from the date of receipt of the goods. Where the information referred to in this subparagraph is provided to the consumer within the withdrawal period, the withdrawal period shall start to run from the date on which it is provided.
In the event that the consumer exercises his right of withdrawal under point 3, the Supplier is obliged to refund in full the amounts paid by the consumer no later than 30 calendar days from the date on which the consumer exercised his right of withdrawal from the concluded contract.
The cost of returning the goods shall be deducted from the amount paid by the consumer under the contract, unless the consumer has returned the goods at his own expense and has notified the Supplier thereof.
The User undertakes to keep the goods received from the Supplier, their quality and safety during the period referred to in point 3.
7.4. The delivery period of the goods and the starting point from which it runs is determined for each good separately when concluding the contract with the user through the Supplier’s website at mdbeautyskin.com, unless the goods are ordered in one delivery.
If the User and the Supplier have not set a delivery period, the delivery period of the goods shall be 30 working days from the date following the User’s order being sent to the Supplier via the Supplier’s website mdbeautyskin.com.
If the Supplier is unable to perform the contract because it does not have the goods ordered, it shall notify the consumer and refund the amounts paid by him within 30 working days from the date on which the Supplier should have performed its obligation under the contract.
7.5. The supplier shall hand over the goods to the consumer after verifying the fulfilment of the requirements and the existence of the circumstances referred to in Article 61 of the Consumer Protection Act.
The User and the Supplier shall certify the circumstances referred to in clause 4 in writing at the time of delivery by handwritten signature, unless otherwise agreed.
The User and the Provider agree that the requirements of point 4 and Article 61 of the Consumer Protection Act will be complied with if the authentication is carried out by a person who, according to the circumstances, can be inferred to pass on the information to the User – party to the contract.

8. AMENDMENTS TO THE TERMS AND CONDITIONS AND THEIR TERMINATION
8.1. These General Terms and Conditions may be amended by MD LAB Ltd, for which the latter will notify in an appropriate manner all Users of the mdbeautyskin.com platform who have registered.
MD LAB Ltd. and the User agree that any amendment and modification of these General Terms and Conditions will be effective against the User after express notification by MD LAB Ltd. and if the User does not state within the 14-day period provided that he rejects them.
The User agrees that all statements of MD LAB Ltd. in connection with the amendment of these General Terms and Conditions will be sent to the e-mail address specified by the User upon registration.
The User agrees that e-mails sent under this Article need not be signed with an electronic signature to be effective against him.
8.2. MD LAB Ltd. publishes these terms and conditions at mdbeautyskin.com, together with all amendments and modifications thereto.
8.3. These General Terms and Conditions of Purchase and the User’s contract with MD LAB Ltd. shall be terminated in the following cases:
- in the event of dissolution and liquidation or bankruptcy of one of the parties to the contract;
- by mutual agreement of the parties in writing;
- unilaterally, by notice from either party in the event of failure of the other party to perform its obligations;
- in the event of objective impossibility of either party to the contract to perform its obligations;
- in case of seizure or sealing of the equipment by government authorities;
MD LAB Ltd. has the right, without prior notice and without compensation, to unilaterally terminate the contract if it finds that the User uses mdbeautyskin.com in violation of these Terms and Conditions, the legislation of the Republic of Bulgaria, generally accepted social, moral and moral norms, as well as in violation of generally accepted rules in e-commerce.
8.4. The User undertakes to indemnify and hold harmless MD LAB Ltd from and against any legal claims and other claims of third parties (whether or not justified) arising out of or in connection with:
- failure to perform any of the obligations of this contract;
- Infringement of copyright, broadcasting rights or other intellectual or industrial property rights;
- unlawful transfer to others of the rights granted to the User for the term and under the terms of the contract;
MD LAB Ltd. is not responsible in cases of force majeure, unforeseen events, problems with Internet access, technical or other objective reasons.
MD LAB Ltd. is not responsible for a breach in the security measures of the technical equipment of the site mdbeautyskin.com, for possible subsequent loss of information, access to information, etc.
MD LAB Ltd. shall not be liable to the User for any unauthorized change of the Primary Contact Email Address.
9. ADDITIONAL CONDITIONS
9.1. The invalidity of any provision of these terms and conditions shall not invalidate all of them.
9.2. mdbeautyskin.com reserves the right to contact the User for the purpose of inquiry/survey/survey. These can be done online or over the phone, as well as in physical form of any nature.
9.3. These Terms and Conditions shall come into force for all Users of mdbeautyskin.com on 08.02.2022.
